I never read the manga, but my guess as to what may happen is the strong black haired guy is gonna want to kill the younger girl criminal causing the blind guy to fight him and die. He did say they’d want to kill those that help the criminals, I can only assume he foresees his own death.

However, this is mostly used for most serious crimes like treason or assasionation of rulers or royal members, and most certainly not for being in a yakuza group, so that's why the yakuza looked so confident in the beginning. The crazy part is that this is still light in comparison to feudal Chinese or Korean laws. They applied the nine familial extermination. The criminals themselves, their parents, their grandparents, their siblings, their children, their grandchildren, their uncles and aunts, their cousins, and their in-laws all get executed. If any of the people in those nine groups are married, their spouses are executed too. The most famous case was during the Ming dynasty in China, where the one and only 10 extermination was carried out. Two things. First, Asaemons are executioners and Eizen is their best executioner, but that is not guaranteed that he is also the best fighter. Secondly, the ranking does not based on their power level alone. It was mentioned it is based on the capability of being the next head Asaemon, which is a combination of many things like reputation, execution skill, experience, trustworthiness, etiquette, seniority, etc. All in all, Eizen is their best overall executioner for all those categories. Sagiri is another example, she is clearly skilled but ranked last because she is a woman, and from this episode we now know that she might not have been ranked at all if not for Shugen.

Shugen is like Stain. A runaway train, and Eizen was the closest thing he had to breaks. Now that those breaks are gone, it’s probably best for the clan if Shugen dies fighting the Tensen on this island. He’s charismatic and well liked enough by the younger generation of the clan that they’d easily follow him in whatever direction he chooses. If he were to become the next head, then they’d become nothing more than butchers enforcing his vision of justice on the world. Even members of the Yamada clan wouldn’t be safe from him and his followers if they weren’t extreme enough in their beliefs and actions.
