Content

Hello. I have just become aware of a very odd situation which includes someone uploading my content to a pirating website. I am not sure what the motive is as eventually my content does become public and I share videos on twitter but I'd appreciate it if you stop. I am issuing a warning to the individual who will be unnamed as I can see the ticket that was submitted to the pirating website, that I will take legal action if this continues. I would like for everyone here to feel that they can enjoy my content but please, I am a human being. Thank you all for your support.

I wish there were a clear guide on how to defend against these thieves, to discourage them and prevent them from continuing their dishonest behavior. Every time I read about an artist or content creator being exploited this way, I feel regret and wonder how we can put an end to these injustices. If there is a way to take action, such as reporting profiles that misuse others' work, please let us know—I would be more than happy to help combat these unethical practices.

Yeah it's unfortunate but I suppose there's no way to guard against it in a way that's beneficial to all my patrons. I'm thinking of of new ways to post content however

Unfortunately even if you attempted to take legal action it would be a very up hill battle. Depending on where you live espically if you live in US or Canada and some parts of European Union, AI is not protected under any copyright and the stipulations for copyright of AI is extremely strict. Your main angle would be for the violation of Patreon TOS and unauthorized distribution of paid content on the platform. Taking it to an actual court of law will probably lose you more than you would gain. As the moral and ethical grounds are already pretty against you because AI is usually created with copyright content without consent from the original creators which may weaken your stance. A cease and desist doesn't do much either because you still would need a more solid case against the issue that would out weigh the use of the AI itself which is pretty difficult. All this also costs money depending how far you are willing to go and the losses heavily out weighs the gains. But for sure copyright is not most likely not an option of attack here in most cases.

I dont think a court battle is something that is even possible nor an avenue i would take, but the only issue isn't it being ai or ethical but it being against patreon's tos and my consent. The most I could do is issue a DMCA takedown which is what I originally intended to do.

DMCA suffers the same issues. Patreon requires DMCA claims to be based on valid copyright ownership. If the AI created was created with a model that does not use your own original work or something in that realm most likely it will not qualify for the claim, as DMCA is still a form of copryright infrigement which you may not be entitled to because it's AI. The basis of whether or not the AI can be copyrighted and accepted for DMCA is up to interpretation and at the discrection of Patreon since there are no concrete laws for AI and it's protection. You can try it, but anything related to copyright with AI is going to be hard to do sucessfully. You arranged and edited the videos (assuming you are using non-copyrighted music in them) may give you some better chance to make a claim, but it will still be up to Patreon. Not a bad idea, but don't be surprised if they don't do it. Until AI gets more regulation and laws behind it, it will be a headache for grey area in this kind of situation. (Basically even if the DMCA gets accepted that won't stop the pirating which is the thing you essentially want to stop.) Scrappers for Patreon are extremely easy to do and is probably the easiest platform to do it on seeing as it is the most popular and has been heavily looked into by scrappers. Until Patreon gets better authentication and anti-scraping tools it will always be an issue.

You mean rule34? I came across your work in rule34 and now I'm subscribed. Or is it some other website?

ZouliHD

Not rule 34. I like it when people post Twitter stuff to rule 34. It's some other website

I suppose at the end of the day I get free advertising out of it being on the pirating site. It's basically impossible to guard against it because of how sloppy patreon is anyhow.
