Hello,

Due to recent events, updates from this post and the majority of Grimdark content will no longer be shown on patreon.

Community members will still be able to access my Grimdark updates.

Consulter and Merchant members can access my Grimdark updates through this month's welcome pack folder and the reward link sent out this month.

Admirer members can access this information through their welcome pack.

Full explanation below:

Okay, so I would like to give a brief update to the community that mainly concerns the Grimdark fanbase.  Recently, I've received another round of DMCA's from the Angry Company (GW).  This happens roughly once a year but this time they really went for it.  They've now made a DMCA claim for every Grimdark post since I started patreon and that includes the private posts.  I've attached the complete list they are trying to get removed from patreon.  That means someone from the company pledged as a community member just so they can file a DMCA claim on private posts.

I'm not a lawyer but I'd really think there would be a violation for code of conduct for trying to DMCA private posts that would be categorized as fanart.  I wasn't even aware they could DMCA private posts until now.  By that logic, any patreon creator who has ever posted a drawing of a Space Marine privately can be DMCA'd.  That is a level of pettiness even I'm impressed by.  And the public posts are incredibly sanitized.  Believe me, I've checked.

As of the time of writing, I don't know how this will play out.  Patreon hasn't really give me a lot of details yet on how to proceed and their infrastructure has undergone a lot of changes over the past year, making it hard to navigate all their required legal steps.  And their response time has become a lot slower and the information they have provided so far is frankly unhelpful.  But the idea of having to remove around eighty posts is just ridiculous to me.  Most worrying of all, I don't know how much time I will even get to challenge all this.  If any community member knows how to backup 80 posts worth of work quickly, I'd like to hear it because there's no way I'm just losing all of that.

But I'm getting ahead of myself.  I'm not sure if every post will need to be removed or only a subset yet.  What I am sure of is that I'm tired of this.  I'm tired of having to deal with a company that constantly harasses my creativity when I want nothing to do with them and have taken every precaution to stay away from their crosshairs and their vague threats of copyright infringement.  So regardless of what posts I might need to be removed, I'll be taking steps to change how I distribute and show the Grimdark content.  I'm not entirely sure how yet, but changes will have to be made for all the Grimdark stuff moving forward.  To be clear, I won't stop making Grimdark content because I am committed to making what the fans want but the methods of showcasing and distribution will need to change if patreon lets this sort of thing fly.

To the GW spies within the community, I commend you for your continual persistence in stifling creativity and the creators who elevated your setting, that is admirable in a stupid sort of way.  Just know it doesn't actually stop creators from making better content than you.

To the Fantasy and Sci Fi community members, I don't think you have anything to worry about.  I've never had a problem with your months.

It will be business as usual right now.  Poses and my take for Maugan Ra will be coming up next. Fantasy poll will be coming up in a week.  Please have your suggestions in before then.  Thanks!

Awesome models and lore explanation as always! Not really sure how to help with posts on Patreon, but maybe some kind of archive would be good solution. I would try maybe classic web.archive.org/save to possibly save what is published already, but I'm not sure how much it will save, especially if there are locked posts for public view - I guess those posts won't be saved. But that's the only idea which occurred to me. Also, your models have been always much better than Angry Company's outcasts, so I hope you will come to some solution for this. They don't deserve what they are asking and should be ashamed, but I guess this is their daily bread now, so I can only hope they can choke on it...

radi4n

Oh, never have I had such a love-HATEHATEHATE relationship with a company. It's astonishing that they consider you SUCH a threat to them - I mean you clearly produce higher quality content and at a much higher rate than they seem to be able to manage as a company vs an individual, but even 80 miniatures (or thereabouts based on 80 posts attempted DMCAs) is a drop in the ocean of their range. Not that I expect you or many other designers would even consider doing so with their past and current bullying actions, but surely a better solution would be....hiring or commissioning some of the individuals that put whole teams of theirs to shame on a monthly basis.

Ayrton Chitwood

Give em hell man. Your Grimdark content is always incredible, I hope you are able to find a place for it where GW can't interfere. They're just jealous anyway.

Tyrazaphael

#1 Cap'n looking so god DAMN GOOD! Sorry the corporate assbags are getting onto you, man. It really is trash, them trying to strangle everyone that does anything remotely close to their IP. If they had brains, they'd lean into the creative types to help them.

Tyrazaphael

Spoiler Spoiler spoiler: If you get time or if you just wanted to, a King version of Valdor would be spectacular. (You know which king I mean)

Russell Byerley

I can't wait! Your STLs are the best and the actual models even more so! I just wish certain companies would leave you alone and let you create. I think you and creators like you do more for the setting than the original company has

Jay B

I'm sorry to hear that someone DMCA'd you. Your designs have been the genesis of my hobby and I hope I can keep supporting you and your designs!

nideininger

i beg you, i double beg you to make this valdor pose available as i want to let him stand exactly like this next to the emperor. awesome model!

radi4n

I would LOVE too see a diorama of the 6 or 7 seconds Alpharius and Valdor exchanged blows.....

Big Al

Damn those pretty boys look sick. This month will be even harder to decide what to do first :O

ChroTal

Unlike other creators you do not even release stuff that competes with gw bread and butter models, but single heroes or busts. It is quite pityful of gw to behave like this. They are terribly wrong that creators like you have any meaningful negative impact on sales. In fact i would argue that you are crosspollinating, so people who dont know 40k can get into the hobby as well.

ChroTal

Ps i do t really see any way how you can involved you patreons, without sharing things. Maybe you can post stuff on a different website and a link to that one. Posting links or just search ke,words to content is not forbidden and cannot dmcD i suppose

ChroTal

Pps. How about a henry cavill head, he is such a custodes fan :)

fractalface

God that sucks. The angry company hates fun as much as their Imperium.

Nicholas Clere

Dear GW..... GTFOH!!!!!!!!!!!! Let this man do the lords work in peace!!!! We love your game, we love your lore, we play your damn gamn and buy your damn products! Let us have this extra bit of immersion through artwork that you have no intention of EVER providing us!

CookingRain 89

If you could make also a valdor Torso version with fur and the beast with horns on the shoulder it would be awesome!

Boris

Stay strong during this time of harassment. Creative content like yours has nothing to do with the decline of GW’s business. A shame they don’t see this and threaten our demand for your creativity. Keep up the good work.

Joseph Mclean

Noooooooo......just when i was getting the models to make oversized statues.

nideininger

actually i got into warhammer bc of 3dartguys emperor. i started 3dprinting and saw this model then i wanted to know more about it and yeah haha

Christopher JENKINS

Loveing the anti-James sass, because you're right, you literally make better stuff than they do. They just hate us 'cos they ain't us.

killin usoftly

if you got to set up your own site ill go there to get your work screw the spys

Genitacles

You've just gotta love how the company that only really cares about it's whales gets pissy when someone else gets the attention of a portion of the other 95%. It makes me miss the good ol days of early napster and pirate bay.

Einarr Done

Kralgor, of Helforged Miniatures got hit with an exterminatus earlier this year, got locked out of Patreon and everything. I know members of the community have suggested setting up a website hosted in a country that doesn't recognise US copyright laws (the DMCA, I know GeeDubz is UK based), such as The Netherlands, Singapore, Honk Kong, Malaysia, Luxembourg, Switzerland, Moldova, etc. Though you'd obviously have to check their local copyright laws, and how they handle copyright infringement claims from the UK.

Kinslord Mpf

pffff but your desings aren't for play, for God's sake!!!

Esther van der Heijden

i fully agree with what is said above i think there is much truth in what they say i hope you can fight thus and win i think that big companys should not be afraid of the little artist who is making beautifull art i think it is the same as trying to stop all the architects because the first original house was a cave build by a neanderthaler so they where the iriginal designer’s but if you go somewhere else with your art ket us know we will follow

3DArtGuy

Hi, I'll see what I can accommodate this month. 👍

3DArtGuy

Thank you, I really appreciate the offer! 👍 It's alright, I think things are under control.

Haha, maybe when the lore has been more fleshed out. 😉

3DArtGuy

Thank you, I really appreciate it! 👍

3DArtGuy

Thanks! 👍 I'll see what I can do. 😉

3DArtGuy

Hi, I'm not sure if I can get to that this month but I'll see how things go.

3DArtGuy

Thanks! 👍 I've never thought of it that way to be honest. 😄

3DArtGuy

Thanks, I'm looking into different options. 👍

3DArtGuy

Hi, check the very last images in the set. 😉

3DArtGuy

Thanks, I'll keep trying! 👍

3DArtGuy

Thanks! 👍 I'll see how things go.

This continues to be such a grey area, especially because the internet has transformed the way creativity operates, while large corporations have been slow to understand this, or choose not to. For a good primer on the context, I'd recommend Lawrence Lessig's book Remix, as he covers the competing pressures faced by creatives and what comprises 'original' vs 'derivative' work in the Web 2.0 era. The reality is that any IP holder could technically force a creative from sharing original works derived from their IP. The doctrine of 'fair use' then comes into play, and goods sold tend not to fall under fair use. I suppose the challenge is whether a Patreon membership is a direct sale of IP-protected content or a subscription to a communication channel that allows the sharing of these items? Whatever the case, the reality is that GW is a h-u-g-e company and they are hardly losing anything – brand-wise or profit-wise – from any modest profit a digital artist might be making on sales, if any. Nothing can stop these corporations coming for the minnows in the ocean – look at how badly Warner Bros treated teenage Harry Potter fans! Me subbing to this and other creatives hasn't stopped me by GW merch, but if they continue to attack those lone creatives I might have to consider not continuing to spend the hundreds on their products I have every year . . . In the meantime, best of luck to you and I'll be supporting your decisions, whatever they are. Thank you for the amazing works you put together!

3DArtGuy

Thank you, I really appreciate the support! 👍

Lloyd Breeze-Timms

Dude you are the top tier of 3D artists I have ever seen, I really hope this works out for you... but if you ever need to go underground you will still have my support. Also, I saw the updates to LEGALLY DISTINCT MONGOLIAN MAN WHO LIKES MOTORCYCLES - amazing dude, I cannot wait :D

3DArtGuy

Thanks, I really appreciate the support! 👍

Seppo K

I think the problem is the US law that states that they can’t pick and choose which material they attack. If they skip even one thing they know about (meaning that it’s publicly available) the whole house of cards that is their IP might end up being public property soon after.

Jay Alderson

yeah, this is 100% correct. I used to sell GW 8-9 years ago and the issue was that by allowing 1 known unauthorised usage of their IP it makes it become a public property that they can no longer control/ stop reproduction of. For that reason the company hits 100% of anything that even comes close. In their eyes it is better to be borderline oppressive than to lose an IP. They have a lot of annoying practices....

Bort

What an absolute joke. If I wanted their overpriced, boring Forgeworld sculpts I would buy those instead. What I DO want is creativty and freedom that I can get in custom models.

Bort

GW continues its trend of making it VERY hard to be a fan.

3DArtGuy

It is very unfortunate and I really appreciate your support on this matter. 👍

Esther van der Heijden

is there something we should do to keep on following the grimdark stuff

3DArtGuy

Hi, yes all community members can still follow the Grimdark WIPs. Please look on the reward page for details.

Joshua Torres

I think they're aiming for the most successful artists due to feeling threatened. I love your stuff and hope you can find a way beyond the clutches of angry company's agents and spies...

Mordo

Tbh it just feels like they are bitching and crying that they can see that the fanart/custom mini community captures the soul of their character better than they do .. thanks for keep us updated

Dushhan Cvetkovic

I do not get why they got to be so petty, I got all of their original models yet I deeply enjoy the flavours that creative sculpts put in the table, it is there to pay homage to the IP we love and enrich and spice up the variety of the models it deffo does not affect gw as we can see by their stocks....

Invasor

Well, it's getting easier and easier to print at a quality they don't offer and for pennies. More and more options and they are trying to put fences to the sea. The same old story, in the end they will be a blockbuster if they don't adapt to the new times. And I buy their products, but as they are terribly expensive and I like your miniatures better, I refrain from painting theirs until I am very sure. I'd rather get the technique of painting with yours, make a nice diorama that has much more details than paying 20 or 30 euros for those.

Russell Monty Rose

FWIW, the way in which corporations behave, their ability to circumvent governmental law & enact their own "laws" is mind boggling. Example... My ISP cut me from service forever (no, I'm not being hyperbolic) for alleged copyright infringement (downloads). Obviously, I deny it, but unlike proper written law, it is "my" burden to prove innocence. Thus trying to prove a double negative. To make matters worse, the ISP threw in my face of the same exact allegation FROM 10 YEARS AGO! Isn't there a statute of limitations on minor crimes, guilty or not? This world is turning into a bad science fiction novel of corporations overthrowing the government. TANJ...

Nicholas

Jokes on them... their stuff is too expensive for me to buy anyways lol. Glad to see you sticking to it.

David Brown

They are IP trolls who back off at the first challenge, as Commissar Gamza, (he has a YouTube channel), found when he was struck by the same nonsense on Cults. GWs IP trolls tried striking down some of his designs. He challenged it and they ran for the hills. If you have a friend who works in IP law ask them for advice on how to send a counter notice and add the kicker that you are willing to see them in a court in YOUR jurisdiction. Watch them back down.

Tarek

you could follow chinaforge and rather than submitting images of what you have created, use a code instead and have the images offsite for outside viewing. however, if you have an infiltrator, that makes it a lot harder!

Scott p Bellman

Do not let it get to you 3dartguy you are one of the best 3d artists I know and your work is the gold standard. Gw couldn't make that claim if they tried. Your work on any of your pieces look far better than the over priced trash they put out.

3DArtGuy

Thank you, I really appreciate it! 👍

Jonathan Renfro

members of the angry company (GW) are always joining fb groups and asking questions about where to find (GW) stl files it's so obvious who they are. I always say nice try angry army. that company is so horrible especial its business practices.

Bort

That's kind of true but the difficult area is derivative works in a legal sense have been very challenged in the last two decades or so. Having said that GW is still running an absolutely archaic Disney in the mid 20th century regime of copyright enforcement, without understanding that remixing media has changed and developed into a full industry in an of itself. Hopefully there's a change of the idiot executives sitting at the top of the heap and someone who recognises that not ALL derivative works are direct competitions to the core products. And, as always, get screwed GW spies.

Travis Lacombe

Keep forging ahead brother! We're all behind you. You're getting this attention because you're doing it better then they are! Don't ever stop, I love your work.

3DArtGuy

Thank you very much, I really appreciate it! 👍

Bort

Could be worth contacting Gamza as well to be honest, if there's a Anti GW playbook it should be passed around.

Chaoticpainting

Just another example of the fucked up system putting its boot on the neck of the working man. It's disgusting. I could see if you were making exact copies of their models and pushing them on ppl that would be one thing. Your models are way more detailed and express the mini in your own style and flavor. When has (GW) ever put as much flair and attention to detail as you have? I'd say never. Yes, they make a good quality, although over priced, product.... but they're not in jeopardy of losing any money here. Fans have always been able to create their art and they shouldn't ever be harassed about it. I'd have a lot more respect for (GW) if they actually embraced us 3D printers and respected ALL of the artists who enjoy their content. Not just the ones who paint all the free minis they send them. You've got skills brother, keep on fighting the good fight, I've been in your corner ever since I got my 3d printer and I'll keep on keepin on as long as I am able.

3DArtGuy

Thanks for the concern, I really appreciate it! 👍

Michael Winterling

Instead of sending their laywers, they should send their HR.

Sean Brandt

Yeah, you'd think a resume would be requested instead of a "cease and desist". I'm new to the Warhammer scene and find I prefer some of the fanart models over the "official" ones anyway. 🤷

Robert Lamborn

Their products are too expensive but they have decided on a path that means a smaller and smaller customer base tolerates ever increasing price. The worst thing about that is there in no backlash from that customer base due to them in fear of missing out or being ostracised. Everyone that can see that wall coming toward them has left the hobby or gone to 3D printing to get what they want & need. Making the "take down files" a free download bundle would be in the interests of the hobby. The links in the txt file have been 404'd.

Arndt Reich

I´m not able to open any of the links, too

Robert Depue

I joined as soon as I found your stuff. It is clearly Gold Standard quality, and much higher than their own. I am pissed enough at the Angry Company for ditching all the old models of the 'Firstborn' and making everything part of their Primaris line the only official stuff. And, on that idea, if it is out of print, then it can be reproduced from their own models, at least that is what the GW Rulezboyz told me quite a few years ago. I do know that once you buy one of their miniatures, you can do what you want with it, for your own personal use. Including making molds and reproducing them yourself. That is an Intellectual Property thing. What you do is clearly fan art or even 'kitbashing' which used to be very much supported. But that was before this advanced digital age and privately available 3d printers and scanners. I think of it like this. I remember when a box of 20 Marines was about $20. I thought it was greedy for them to sell the name chapter boxes of 10 that were pewter and plastic for $35. This was Dark Millenium era, so... 2nd edition? It only got worse, and by 5th Edition, we finally had a Land Raider model again. For $65. Insane. Now? I looked at the prices for the Primaris stuff. I no longer play in any form, and even I would be tempted to buy a single box, 3d scan them, and 3d print them. Because you could do an entire chapter of Marines with vehicles, characters, and extras that were of your own created chapter much cheaper, with a bit more work. And that includes the cost of the scanner and printer. And materials. The sad thing is... as long as you didn't sell any of it, and it was all for your own use and enjoyment? The Angry Company can't say a thing, because you bought the initial stuff to make it all. Our new digital frontier is making it so the Angry Company and others like it have a harder time making money. The problem is in their thinking. At least their thinking now. They used to support people that would elevate their own things. They have always hated pirated models, and pursued the ones making them. But. If you made your own, and showed it off, they would show it off too. Now, their thinking is all about the money, not the hobby. Sales drop? Raise the prices. Costs go up a little? Raise the cost a lot. I used to love GW paints, and insist on only using them. Now? Nope. I have converted to Army Painter. Comparable quality, at least to me, and a lot cheaper. Their solution to everything bad is to raise prices. Because it couldn't possibly be that they are just throwing models out every edition or two to keep people buying. And that means now, that they chase after anyone that might threaten a single dollar of theirs. Please keep making the quality Grimdark stuff. I like all of your stuff. But, my old gamer heart really likes the Grimdark.

3DArtGuy

Thanks for the concern, I'll keep trying to make cool stuff! 👍

Mark Davison

To echo this - I was fortunate enough to see a sample of your work on someones "new STLS for Jan" and 10 minutes later signed up for the patreon - truely some stunning show case models in you back catalogue. its not hard to see why they want to shut other work down, but still sleezey behaviour (you'd have though that their recent record breaking profit reports would have left them in a good mood.. but never mind...)

Brainspace

I agree with you 100%. There are other companies out there doing the same thing, and I find it preposterous. It doesn't effect them, and in fact, it only fuels passion for the IPs. These people at these companies are the definition of stupid, and greedy in ways that are simply disappointing.
