A false statement only counts as Defamation once it causes damages to someone's reputation or their ability to make a living. And the 1st amendment only applies to your protection from the Government. Not from private citizens. But in short, you're free to talk as much shit as you want, until that shit talk, if false, starts to fuck up someone else's money and rep.

Defamation is if I say publicly“ Leo broke in and stole all the underwear at Victoria’s Secret!” When we know it didn’t happen. That’s still not a criminal act it’s a civil act which I could be sued for but not put in jail. There’s only a handful of things you can say that will get you arrested. Yelling “FIRE” in a crowded building when there is no fire is an example. That would cause a panic and people could legitimately hurt or killed. This is why lawyers make so much money cause they can argue either side and leave it up to a judge or panel of judges to decide
