I don't think much would happen to Maomao for making medicine sort of "under the table" as it were - the Emperor already knows and had asked her to look after Lihua early on (obviously in a medical capacity). It probably would be more of an incident if it became widely known that Maomao makes it, as it could cause other nobles or higher ups to use that knowledge against the Emperor in some way, or maybe Jinshi, or one of the concubines, and likely Maomao herself.

Also, I don't think that rule would have been as big of a deal outside the Palace itself. She was openly experimenting and making medicine with Luomen and even at the Verdigris itself.

It is explained a little better in the Light novels than it is in the anime at least so far that the palace kind of is looking the other way when it comes to MaoMao making medicine and being all but a full doctor without the title.
