Unfortunately, this video has been demonetized since I discuss abortion. This is not really much of a surprise, but I wanted to also bring up that this is yet another reason why I am so grateful for your donations on here, since this ideally I wouldn't ever have to worry about ad revenue to begin with.

Which other Supreme Court cases should I cover for this series? I plan to pick up production of them in the fall.

Thank you for your continued support!

Wait, When Are Abortions Legal? | Planned Parenthood v. Casey

In episode 61 of Supreme Court Briefs, a complicated Pennsylvania law restricting abortions gets challenged, and pro-life folks hope Roe v. Wade will be overturned and abortions will be made illegal. Harrisburg, Pennsylvania The 1980s The Pennsylvania legislature passes and amends a law meant to limit abortions in the state. What did that law require? That a woman seeking an abortion had to give her informed consent prior to getting it. That the doctor who would perform the procedure had to give the woman what could be interpreted as anti-abortion propaganda at least 24 hours before the procedure was to take place. That any girl under 18 seeking an abortion had to get the consent of one parent. That any married woman seeking an abortion had to show that she notified her husband of her intention to have the abortion. And finally, the law required abortion clinics to be more transparent and keep better records for the state to see. In response, a group of abortion providers, led by Planned Parenthood of Southeastern Pennsylvania, sued Pennyslvania’s governor, Bob Casey, who had signed the law limiting abortions in his state. By the way, Casey was a Democrat, believe it or not. You may remember them from like, almost every other episode of Supreme Court Briefs, but the American Civil Liberties Union, or ACLU, decided to help Planned Parenthood in this case. Ok, so the U.S. District Court for the Eastern District of Pennsylvania determined that all those abortion restrictions were unconstitutional and forced Pennsylvania to not carry them out. And so, Casey appealed to the Court of Appeals for the Third Circuit, which mostly agreed with Casey, only concluding that the husband notification part was too much to ask since it potentially could make women vulnerable to spousal abuse, violence, or economic insecurity due to reactions from their husbands. One of the judges in the Appellate Court, future Supreme Court justice Samuel Alito, actually dissented on the husband notification part, saying it WAS reasonable. Anyway, this time Planned Parenthood appealed, this time to the Supreme Court, who was actually very interested in looking at another abortion case since Roe v. Wade first said it was ok for women to have abortions. I do have a video on that case, don’t ya know. So here’s the thing. The Court looked a lot different in 1992 compared to how it looked in 1973 during the Roe v. Wade decision. It was supposedly a much more conservative bench. In fact, in 1992 there were eight justices on the bench appointed by Republican Presidents.

I'm sure this is not going to be controversial at all

Jack Bartlett

Hollingsworth v Perry because even though it's about same sex marriage, the real issue is Article III standing. That's something that isn't discussed often in supreme court briefs.

Jack Bartlett

Engblom v Carey because it's one of the few 3rd amendment cases.

The cases ruling is heart braking i think by finding that one clause as reason for the ruling they set up men for being abused. i have heard of cases were a mans child was executed via abortion because of the women braking up, or pressure from her parents and this case took away the mans ability to defend his child if the child is still in the womb. I also find their usesage of the Constitution to be shaky and really bad word play to justify their ruling.

Devin Canada

Interesting notes too. Jane Roe is now pro life. Alveda King the niece of Martin Luther King Jr. is considered by some as the leading pro life Advocate.

Devin Canada

I really want to see you do "Ex Parte Bollman" this supreme court case gets my blood boiling but I don't know the full story other then in involed Aaron Burrs plot.

Matt Beat

Thanks for sharing. I do wonder if they will be overturning this case in the fall.

Can we have a F for Mr. Beat's video for being Demonetized

Devin Canada

This is the first ive heard of this but There seems to be doubts on that. it was a death bed confession and she was unable to revew the scene before she died. Interviews have been doctored before and being paid as a speaker is common practice so i doubt she was offered money to change views but only to speek. its possible that she saw a opertunity to switch sides and make money but i really call it iffy. Abby Johnson another pro life leader who used to work for planned parenthood said that she believed McCorvey was a damaged woman who should not have been thrust into the spotlight so quickly after turning against abortion. "I don’t have any problem believing that in the last year of her life that she tried to convince herself abortion was OK. But I know at the end of her life, she did not believe that,"

Matt Beat

Interesting. I think it is revealing how desperately both pro-choice and pro-life people want "Roe" from Roe v. Wade to be on their side.

Devin Canada

yeah kinda a tug of war that likely caused her more stress then it was worth.

Crazy to think a Democratic governor signed these restrictions into law! As Bob Dylan once sang, “The times they are a- changin’ “ Do you think there will be a Supreme Court Case about the legality of statewide mask mandates? (Sadly, I am only half kidding)

Naterade

I have never understood why people aren’t outraged that more half the justices were appointed by presidents (Bush and Trump) that lost the popular vote. How is that Democratic?Darn electoral college!

Hi, Mr. Beat, a good case to look at would be Miller v California of 1973, where the Court changed the legal definition of obscene materials.

Matt Beat

I've totally wanted to cover that one for awhile but actually forgot about it! Thanks for suggesting it.
