Please welcome LSM legal analyst and friend-of-the-show Rick Hoeg back to Sacred+ for another wide-ranging conversation about a number of interesting topics. Mere hours before we began recording, we learned that Sony would be pulling Concord off of PSN and refunding all players at the point-of-sale, and thus we begin there. While we'll leave the primary conversation about this hullabaloo to Sacred Symbols itself, I (Colin) thought I'd pick Rick's brain about some of the noise surrounding such a radical choice. Why can players be forced to accept a refund even if they don't want one? What kind of stipulations and rules exist around taking a multiplayer game offline so soon? By bringing revenue back down to $0, can Sony now write Concord off even though they opted to release it? Other topics include a look at the seemingly-faux Black Myth: Wukong timed or "secret" exclusivity drama, how Vampire Survivors got away from so deeply copying Konami's Castlevania IP, and aggressive labor actions at French publisher Nacon concerning two of its key studios. Please enjoy.

FYI and not to be that person, NFL has started the week after Labor Day for as long as I can remember. It’s not early this year. College always starts Labor Day weekend and the NFL the following week. Labor Day weekend is the only week w college games on Sunday and Monday bc it’s unopposed by the NFL. The Jets first game in 2014 (ten years ago) was Sunday Sept 7th. It’s not new.

Big titty drinker

The players have spoken. We don’t want your live service trash.

BigDumbStupidIdiot

If Hoeg likes your live-service game, it's dead in the water

Otacon_Ocelot

I recorded the bit about football and what is the pecking order in things you care about Colin and sent it to my wife, she replied with he is you lol replace Jets with Bama and NFL with college. Although within the last few years living in Detroit I’ve become a pretty big Lions fan, especially since they have more than a couple Alabama top round picks.

We really can't avoid sports in any episode of anything, can we? Haha. So much time to fast forward through.

Fire all 169 mentally ill members of Firewalk Studios immediately. Announce a remake of ModNation Racers. This is how PlayStation makes us whole. Restoring faith in the brand.

Did Dustin really say that the clear goty is mid?

Hey Hoeg the only two copyrights or patents I’ve seen go dormant are Loading Screen Minigames from Bandai Namco games in the late 2000’s to the early 2010’s to the Nemesis System from the “Middle Earth Shadow of” series. Is there anything keeping other dev teams from using these mechanics from a purely legal basis as opposed to general difficulty in implementation?

Jeff in NOLA

On Vampire Survivors, it’s hard for me to care when the company that holds the IP and is legally “harmed;” doesn’t care at all

The Concord brand should never come back. It’s pure poison in every way that matters at this point. Knives are now out for PlayStation when it comes to service games. Concord, Factions, Bungie, the continued mismanagement of Helldivers 2…just a terrible track record, and the non-PlayStation multiplayer audience now takes pleasure in seeing Sony eat shit. It’s a total nightmare scenario for their service games initiative, even if they don’t realize it yet.

Matthew Cooper

My prediction is Concord stays dead and buried; I really don't think it could ever have enough players or make enough money to sustain itself. Hopefully the studio survives, but I have serious reservations.

FlynnTaggartGuy

Wonder what is going to happen to the Concord episode of the Secret Levels show.

King Blob

The market has rejected concord. Making it F2P won’t do anything

Somehow Epstein Returned

I'm behind an episode and listening to last week's now. I'm going to assume that multiple wrote in but I will say once more: Fergie in OutKast???? It was said twice with no correction, I thought I misheard the first time and then Colin said it again. Colin getting the Black Eyed Peas and Outkast mixed up is the most Grandpa Simpson moment on the show I've seen.

I really thought the value of sports teams (and e-sports teams as Hoeg mentioned) was interesting, but when Colin said "anyhow everyone's going to sleep" I lost it. The timing was perfect

I wonder if Concord is an example of the dangers of having a Jim Ryan run a company. Someone familiar with the numbers of an industry, but not part of it. Concord's trailer drop had a visceral reaction from every gamer. Universally all gamers knew this was going to be a dud. However, Ryan wasn't a gamer. He doesn't get the product. To him, Concord looked like Overwatch. He didn't understand the art, and why it wasn't.

Hoeg is so great. He balances his legal expertise and general gaming interest and enthusiasm so well, he always adds to the conversation thoughtfully
