They are in Boston, so very much Murrica! First season they were in LA, and then beginning of 2 they moved to Boston where Nate is originally from I looked it up back when I first watched this show. Apparently you generally are allowed to cross state borders with alcohol for personal use - the amount varies by state though and in some you need a permit to do so. Generally this is not really enforced though (unless you obviously carry an amount you want to sell, which you do have to declare in each state!) and if they happen to catch you with slightly too much, you usually just get a fine. That is the point of the episode though! This is not legal advice!!! I'm neither a lawyer, nor Murrican - please do your own research before carrying a bear across state lines ;)

And the alcohol also has to be unopened, including things like 24 packs, but that's true even if you weren't crossing state lines.
