We're implementing some changes to our Terms of Use around streaming and/or recording using our official app. Moving forward you must obtain explicit permission from all players and the Storyteller before capturing or sharing gameplay. Additionally, recording or streaming minors is strictly prohibited under any circumstances.

These changes are designed as an improvement of the safety of users on our platform, particularly minors.

Here's the full overview of the changes made, coming to your terms of use. Please make sure you familiarise yourself with these new rules before your next game of Blood on the Clocktower Online!

Recording and Streaming. Users may record, livestream, broadcast, publish, or otherwise share audio or video of gameplay conducted through the Service only where they have first obtained the permission of all players, the storyteller, and other participants whose voice, image, username, gameplay, communications, or other participation may be captured or shared.

It is the responsibility of the user recording, livestreaming, broadcasting, publishing, or sharing such material to ensure that all relevant permissions have been obtained before recording or streaming begins. If any participant does not consent, the user must not record, livestream, broadcast, publish, or otherwise share that participant’s involvement in the game.

Users must not knowingly record, livestream, broadcast, publish, or otherwise share any gameplay involving a minor, or any voice, image, username, communications, or other participation of a minor, through the Service.

Users must not mislead other participants about whether a game is being recorded, livestreamed, broadcast, published, or otherwise shared. Users must also comply with all applicable laws, platform rules, and third-party rights, including privacy, publicity, copyright, and data protection rights.

Failure to obtain appropriate permission before recording, livestreaming, broadcasting, publishing, or otherwise sharing gameplay, or any recording, livestreaming, broadcasting, publishing, or sharing of gameplay involving a minor, may be treated as a breach of this Agreement and may result in corrective action, including removal from a game, warnings, suspension, termination of access to the Service, or other action deemed appropriate by TPI in its sole discretion.

If you want to do this, you should add it as a session option and make people agree or quit when joining. It's a simple code changez and that way there's no ambiguity

Ashutosh Jindal

Any chance this might get implemented as a feature in the app? (If the host marks the lobby as recorded/livestreamed then users who sit down get a notice and an option to give consent?) I understand that might shift the burden to TPI

Henry Levenson

I think that everything laid out is reasonable and good. If this is going to be a policy applied to the online app I agree with the folks who have commented before me that the app should have some sort of way for folks to display they are streaming/recording etc so people can know or avoid said games - and that folks joining said lobbies understand that there is a stream/video occurring. (Edit a nice individual in the comments has pointed out there is already a streaming notification that can be used)

Emily Shaw

There is currently a “this game is being streamed/recorded” toggle but not everyone notices it

Blood on the Clocktower

Hey Zy, that's a very reasonable request and we already have plans to overhaul the way the "this game is streamed / recorded" tag is being used on the app! The idea is to make it something each user can set for themselves and everyone else would then be notified in some way on the app, including before joining a lobby. - bra1n

Ah thank you, I did not know this as I don’t stream or recording anything.

Jonathan Skårstedt

We have some storytellers in our community who are 16-17, are we talking about age of majority here? Just want to know how to apply this

Arif

We're currently defining a minor as someone under the legal age of adulthood, within the law of their province, state, or country. If those storytellers currently fit that definition then this policy applies. - Arif

Jonathan Skårstedt

Thanks for the reply! Clearly not optimal for us but we'll have to celebrate them with a stream when they reach legal adulthood!

Leslie G

Fyi this miiiiight cause some issues/ confusion in the future due to a direct contradiction within your current ToS i.e. TPIs BOTC "SECTION 18 - GOVERNING LAW" rule which names Australia as the governing legal body for all BOTC ToS. Additionally, there are counties in which "legal age of adulthood" may be ambiguous Ex: Singapore, minor until over age 20 or until married; Scotland's age of legal capacity being 16, 19 for South Korea, I think there's a handful of countries where you have to be 21 to be legally an adult, and then there's whatever TF Kansas is doing these days... And then, do you take into account emancipated minors? Don't get me wrong, I am an overprotective auntie who occasionally lets my niece play so I absolutely love tpi making a ruling here. But I would have questions for the legal experts who drafted the verbiage of this rule.

MayoStooff

Just was curious about a clarification, would old posts and recordings involving minors need to be taken down or would they still able to remain up as it was before this update???

Leslie G

Also the contra proferentem waiver clause in the ToS is unlikely to make a significant difference based on precedent. I know they're extremely common but I get so irritated every time I see one, like c'mon you can't preempt judicial discretion.

Seth Tanner

I like the idea of eventually implementing in the app a pop-up notifying lobby members upon entry that a game is being broadcast, with options of “okay” and “leave”. Users would have to interact with the pop-up in order to close the window and spectate/claim a seat.

Simon

Does tagging a server as recording count as obtaining permission from people who join mid game?

Azzy

And what about private games?

Arif

This applies to all games on BOTC.app - Arif

Azzy

but why, we host, record, edit our videos with a group of friends in private games, and we just cant do that anymore?

Arif

You can do that, so long as you have everyone’s express permission. Nothing in the above states that you can’t do that, unless your group is full of minors. - Arif

Azzy

I'm a minor, we have a few minors, we make are channels revolving around botc cause that's what we love to do, do we have to change platforms now? And how is this going to be enforced, because at a certain point it is just hearsay.

Eric Miller

What a weird change to fix something that isn't a problem. This smells like someone had a personal issue that they feel had to be made into everyone's.

Arif

Recording or livestreaming someone without their consent, or when they are a minor without parental consent, is a problem. - Arif

cyberjoel

What about rooms flagged with "game is streamed" does the permission request still take effect? Also if your actively streaming and there's a late join how would that work?

Caitlin Oddy

However just putting that up isn't the same as getting explicit permission, you'd have to draw attention to it so everyone knows and you're not relying on people noticing it

Caitlin Oddy

This is a brilliant step in the right direction, good job TPI

Holly Ogden

Yeah it’s just in a public game it is usually understood that there is no reasonable expectation of privacy.

Jays Short

One consideration here - and the same issue that Australia's efforts to curtail social media risks to minors - is that absent a strict mechanism for verifying a participants age (and location - given jurisdictional variations of the age of majority), determining capacity for consent is always going to be a challenge.
