So the thing about the tape recorder that you thought, here’s the thing about American law: you cannot introduce new evidence in trial. It all comes out during discovery, and then you’d generally have depositions, all evidence legally mandated to be reviewed properly by ALL parties prior to trial. Therefore it would be just blatantly illegal and get Jimmy instantly disbarred for attempting to introduce new evidence at a trial. The rules here are looser as they are a disciplinary BAR hearing, rather than a full trial, but that’s a big thing legal dramas often get wrong, and as this show is fairly realistic (LegalEagle on YouTube has legal breakdowns and gives BCS fairly high praise most of the time) it wouldn’t make sense to have something blatantly illegal be done, its all about the gray area in how Jimmy practices law.

Jimmy is not a victim, he's an asshole of a brother who even used Chucks ex knowing it was going to hurt her enough to hate him. He sabotaged his brother and caused him to have a mental breakdown to cover up his illegally forging documents and ruining his brothers life to save his shoddy career. It hurts Jimmy so much yet he still did what he did. If you cant tell I am not a fan of him in this storyline at all. lol
