To answer the end of the episode: He was quite literally filled to the brim with burgers and he couldn’t fit the M’Guffin in his gullet. All the burgers he ate were blocking it.

To answer both questions asked: 1. Yes, the "spit burger" was chucked out before Richard could eat it 2. Richard was so full of burgers, he couldn't eat the M'guffin lol
