No, Montoya doesn't know for sure if Gordon killed Oswald but it is a common tactic, while doing an investigation, to interrogate people with the assumption that the suspect is guilty. It's a way to get information that either leads to them being the one that did it or rules them out. I'm not defending her and she was wrong for just entering their apartment but just pointing out that a lot of times, that's what cops/detectives do.

Mark Chrisco

A seminal crimefighter from 1930s pulp magazines. a long running radio series and a 1994 film (worth a viewing?) starring Alec Baldwin was The Shadow. Some say he was inspiration for The Batman. His real name was LAMONT CRANSTON. Both names figure prominently in this episode.

Montoya is only wrong about Gordon because Gordon tricked everyone to believe that he did kill Oswalt. From Montoya's perspective, she is completely right for warning Barbara about Jim. If someone you love is dating someone you truly believed to be a murderer, wouldn't you warn them?
