just cause they bullet didn't match doesn't automatically mean it was a different gun, it just means they couldn't prove definitively that the bullet came from that gun. the defense is alleging this claim using the ATF summary to create plausible deniability. it a decent strategy, but it doesn't mean the defendant isn't the shooter. the absence of evidence is not the evidence of absence.

looking into ballistics test.....false negatives happen around 3% of the time, largely due to the condition of the bullet fired, and probably in this case, how well the markings from the rifle appear on the bullet. the bullet could've been too destroyed to tell or the condition of the gun didn't create good markings, it's a fairly old rifle, right? so like, if I was a defense lawyer, it'd definitely be claiming my client wasn't the shooter based off this, but then it becomes a "then why were you there with your grandfathers gun and then did all the running and hiding and confess to your roommate that you did it, if you didn't shoot him?" sorta situation.

Shrimpmaster, not quite. yes, overall the prosecution has to convince a jury he committed a crime, but they do not have to definitely prove everything piece of evidence to do so....meaning a failed ballistics test isn't enough to set him free with all the other corroborating evidence the prosecution has on him. the prosecution just can't tell the jury the bullet came from his gun.
