The next episode of Broken Silicon will see us be joined by Hoeg Law once again! Richard is a Business Lawyer, and therefore is more than happy to answer any and all questions having to do with Tariffs! However, he is also an avid gamer and has a lot to say about anything involving the consoles or semiconductors - so feel free to ask him anything! Might I remind you all that this is a rare opportunity to ask some very unique questions...so don't miss this opportunity! At a minimum though, we plan to discuss:

Tariffs - which products will be most affected, and the legality of how they were instituted.

How easy tariffs will be to get around.

How realistic a joint venture between Intel and TSMC, is.

How likely is it Nintendo will raise the Switch 2, controller, camera, and/or game prices due to tariffs? How much will the tariffs affect the MicroSD cards (as Nintendo uses them for the Switch 2 and they're already fairly expensive at $60 for 256GB for the required Express cards)? How much impact to expect on AMD product prices from tariffs? How badly will Apple be hurt by the tariffs? How long do you expect the tariff war to be going on before a deal gets struck to end it? If the tariff war doesn't end, how would the low income individuals (especially minimum wage and below, including those of us only having Supplemental Security Income to live off of) survive?

Is Richard looking forward to any Switch 2 (or announced GameCube NSO) games? How about Tom (and Dan, for that matter)?

Curious his thoughts on Nvidia shifting client GPU capacity to 18A while letting TSMC satisfy volume on server. Generally the need for diversification of supply chains as well given the tariff stuff kinda proved the need for it too. In AMDs direction I’m curious if or what he thinks they should in regard to their supply chains. I personally think Samsung would a great long term partner to get close with as they hopefully bring their fabs up to speed as time goes on.

Regarding tariffs as well I’m curious on both of your thoughts on the risk of law-fare against US companies within China which would include Tesla, Apple, Intel, etc, and what that would entail for our companies going forward given whatever situation you think that would cause would come to pass.

Last one I’ll ask is I’m curious how you guys read what TSMC has been doing to potentially avoid tariffs, and whether or not you think it’s been effective or worthwhile for their business. I know Trump seemingly is hesitant to believe the $100B investment will fully realize due to some of his comments regarding tax rates if they don’t go through with it. Given that do you in any capacity think TSMC has kinda put themselves in a corner doing these investments with no real promises of actual relief on the admins trade plans? And given TSMC is hurt through these tariffs do you see that in capacity pushing companies towards Intel with the caveat that 18A is good enough to allow that for these companies.

As Ive listened to some experts of international (geo)politics repeat in international affairs there are no binding rules nor laws per se, only interests aligning, as we see more and more now... what is role of laws, contracts and regulation in this scenario of multi country trade for corporations? Why spend fortunes on lawers when unilaterally other side can for political/ghosting reasons dictate contracts are paperweights ? India is one of these countries that read IPs for their domestic benefit (no international patents hold there) in many cases like drugs. Are these case by case basis(per company and project)? Previous Hoeg Law cases have been mostly US company mergers (Microsoft buying another US game company publisher). In context of TSMC and Intel this conflict could become tense. Second option is Sony, HQ in Japan, potentially buying US company.

whats the general expectation of how tariffs will affect semi conductor / eletronic goods prices globally? theres been a ton of talk as to how it affects the USA but not really much else of the world, i actully am austrlian and are trying to atleast get a vague idea on what other places should see happen around the world

Why would TSMC consider a deal to acquire or utilize Intel's manufacturing facilities in the US when they're already investing billions in their own US manufacturing plants? Wouldn't it be more efficient for TSMC to continue their independent expansion rather than taking on Intel's facilities? And who is actually making these claims about a TSMC-Intel facility deal? These rumors seem as far-fetched as speculation about an Intel-AMD merger.

Hello, what do you think is the most destructive element of tariffs? I would argue it's unpredictability. Working in business analytics, I know we'll spend weeks or months trying to determine the impacts. For companies, this unpredictability is disastrous as it completely disrupts their planning cycles.

Given Intel’s struggles, how likely is it that they enter bankruptcy?

Will companies absorb any of the cost of the tariffs?

During CES 2025, we saw a lot of 3rd party vendors show off Nintendo Switch 2 accessories. Would that count as breach of some sort of contract/NDA, or did the vendors have some sort of counterargument that Nintendo felt was too strong to litigate against? It was odd to see Nintendo NOT attempt litigation over this.

Hey Tom and Richard - I lived in Australia back in the 1970s as a middle schooler. At the time tariifs were high and watchs to cassette players were like 2x the price of the US with a gray market for a lot of imports. A lot of external exporters may decide to stop exporting and work with an importing wholesaler which adds another 15% for a middle man. Like when Land Rover says goodbye a wholesaler has to step in. I assume the minimal price increase will be at least 2x the tariff. What do you believe the price overage will be above tariff rates? Second it seems some electronics have tariff carve outs what carve outs are expected to stay in place?

How do you read the ongoing legal warfare between Qualcomm and ARM? It seems ARM is trying to monopolize ARM server CPU merchant silicon (buying Ampere, trying to kill Oryon core architecture), and broadly even core design (trying to kill Oryon and pulling back on architecture licenses). Will we see ARM achieve this monopoly? Or is it more likely ARM will be forced to open up its license as Qualcomm wants/needs?

What would the likelihood be of regulators allowing AMD to buy the design/patent side of Intel?

Good day you two, Reuters and other News show that Intels new CEO being linked to many Chinese investment Companies and Intel states that Lip-Bu Tan stated the potential conflict of interest before becoming CEO, could these facts complicate cooperation between TSMC and Intel?

With the trade war triggered by the current administration. Hitting our allies (EU/Taiwan/UK/Japan/Australia) and enemies (Russia/China/Iran/NK) alike can we discuss the overall impact on prices moving forward for american consumers a bit. My question for both guest and Tom is. With this trade war is there any path to restoring low cost manufactured goods, or because of the destruction of American credibility and stability, will we now see decades of price hikes and inflation that further increase wealth inequality with the regressive tax that are tariffs on goods.

progressivismIsPrettyCool

Will companies get cutsie with importing by trying to obscure countries of origin and import mostly chinese goods through other less restricted markets?

Hi, How does the law typically decide what the value of a product is while calculating Tariffs. Production, distribution, retail, and profit all are pieces of the pie and how much of the pie will be taxed maters.
