One glossed over item here is the generally referenced "...right to privacy..." is not clearly defined and the Supreme Court only loosely acknowledges some aspects of this exist w/o expressly stating it does. This is how/where Google/Facebook have had to face some levels of scrutiny within the EU that they do not face in the US. Because it is NOT clearly defined and only loosely inferred from other laws.

Wouldn't a "due burden" be something like "must be performed/prescribed by a trained professional", "must use equipment that has been properly sterilized", etc?
