So just in case you guys missed the point of him testing Garfield, is that he is slowly losing his regard to his own life because of return to death. So because he knows he can just restart, he is being more bold every time he dies. This is another shift into his character development.

Remember that when return by death happens, the scent of the witch is much stronger on him for awhile. I'm not sure if it ever disappears or what but since garfiel can smell it, he's assuming that subaru is either with the witch's cult or is associated with the witch in some way. So depending on how subaru acts, garfiel acts accordingly.

They aren't the same person they just look identical which is why Emilia is basically persecuted. If you look they have slightly different Hair accessories. That's really the only way to tell them apart atm.
