so homicide has degrees and 1st First-degree murder is the intentional killing of another person by someone who has acted willfully, deliberately, or with planning/premeditated and then everything else is just murder but sometimes called 2nd degree they do not have the specific intent of premeditation but rather malice aforethought (like you still thought about it (even like the second before you decided to do it) but it wasn’t planned out like premeditation) and includes 4 categories, 1. intent to kill (like you intended to kill someone, this is the most common one to use the affirmative defense of self defense) 2. Depraved heart ( Killing someone in a way that demonstrates a callous disregard for the value of human life) 3. Intent to cause Grievous bodily harm or 4. Felony murder (Killing someone while in the process of committing a felony, specifically burglary, arson, robbery, rape, or kidnapping) And then you have homicide that is not murder aka manslaughter. They do not require malice aforethought intent Voluntary Manslaughter: This typically occurs when a person kills another in the "heat of passion" due to a sudden provocation, like a fight where someone is killed. The key is that the killing happens suddenly, before the person has time to cool down. Involuntary Manslaughter: This involves unintentional killing resulting from criminal negligence or recklessness, or while committing a misdemeanor that is not inherently dangerous
