I think the guest may not understand cross examination—the canonical technique is to ask closed questions in the form of a statement, to which the answer should just be “yes, yes, yes, yes.” You also usually repeat a certain amount of information for multiple reasons—to confirm facts and set up a line of questioning/commit the witness to their statement before impeachment/establish that your line of questioning is within the scope of the direct. So I’m not sure what issues Kaplan was having with his questioning, but closed questioning is absolutely fair game as is a certain amount of repetition

I'm glad Jacob touched on the Michael Oher case because the contrast between how Lewis talks about Sam and how hes talked about Michel Oher, both now and in the past when "The Blind Side" came out, is absolutely maddening. Honestly hard not to read the guy as a huge racist. I don't really follow the NFL or college football but I've found the Oher case really interesting to read about, would love if you guys did an ep about it, or on the NFL/NCAA in general. Not a lawyer (yet — 2L), but the defense should be asking leading (“yes” or “no”) questions on cross-examination. However, if those leading questions aren’t forwarding the testimony of the witness, then the judge would have very good reason to get pissed.

I’m sure Kaplan still thinks that Cohen is “a good lawyer with a tough job.” But Kaplan can’t make any such acknowledgment in front of the jury because it’d be extremely prejudicial. Kaplan just knows what the government knows and what the defense knows: there is no viable defense. Sam’s statements post-FTX collapse are arguably sufficient to convict on their own. Kaplan is sympathetic, but he’s not going to stretch the rules of trial practice to let the defense out of the tiny corner Sam has backed them into. Their seeming grasping at straws is because there’s nothing they can get on cross examination that will be helpful. That’s why Sam will testify; it’s all they have left.

Re: Brace saying it would be easy to do a good book interrogating EA...there's good book called Strangers Drowning by Larissa MacFarquhar that profiles a lot of EA people and is critical of it. It's from 2015 and I think kind of pre-dates EA being so big in the tech community? which makes the EA angle of this SBF stuff crazy to me because any journalist who would've had to look into EA while covering him should've found that EA people (1) are like, anxious 24 year olds who live in the cheapest apartments they can find and eat only rice so they can donate more and (2) very much reject politics in favor of philanthropy. So the Bahamas mansion and bankrolling Dems should've been big red flags. It's like two separate things, EA is simplistic and dumb and wrong, and also none of these tech people were ever serious about it and it should have been so obvious.
