Here's one comic that won't appear in my upcoming book of cat cartoons because of copyright issues. The blurred out text on the man's vest originally said "Service Human." Turns out that's a copyrighted term. Here's how I found out:

I was selling a T-shirt design based on this cartoon in my Teespring store. A few weeks ago, I got an email from Teespring's Intellectual Property department saying they removed my T-shirt design from their site because the term "Service Human" is trademarked.

A little frustrating, but totally understandable. I emailed them back saying I understood and that I was glad they're responding to intellectual property issues.

The next day, I tried to log into my Teespring account and couldn't get in. I thought the site was down for maintenance. I tried later and still couldn't access my account.

Teespring had booted me off their site because they have a "one strike and you're out" policy for copyright infringement violations. I exchanged a bunch of emails with their Intellectual Property team, politely explaining my case - I had a long history with them, I had no idea that "Service Human" was a trademarked term, my artwork was my own, etc. It was an innocent mistake, guys. Let's move on from this.

But they didn't budge.

So after spending some time licking my wounds (and poking pins into my Teespring voodoo doll), I started looking for a new site to work with. I'm putting together an entire new store to sell T-shirts, mugs, and other merch. Stay tuned.

And to Teespring: our time together was magical, it's too bad we ended on a bad note, and you are dead to me. (As you can see, I'm still working through this.)

Enjoy the rest of your weekend!

EDIT: I used the wrong term earlier. "Service Human" is trademarked, not copyrighted. Also, I'm going to change the wording on the vest (there are many other options) and put this comic the book.

Wow that's unbelievable! How strange that the phrase 'service human' would be copyrighted. I would have never guessed.

Wendy S. Katz

well that stinks. I hope you end up with an even better store!

Kimberly Beckham

People copyright everything now it's really difficult. I've used Zazzle for many years and even had the same problem but they've never booted me off for it they've just removed the item.

Scott Metzger

Yeah, most print on demand sites will remove the content and will only ban repeat offenders - those who are intentionally stealing other people's work. Teespring's "one strike" policy is a bit strong, in my opinion. But as someone who's contacted various merch sites about my work being stolen and sold, I'm glad they respond to copyright issues.

Dave Elliott

Scott. That sucks. Will support your work on your new site. Love your stuff... You have made this pandemic somewhat tolerable ...thanks for the laughs !

Scott, I love the shirts, glad I got one for me and the wife, your artwork is the MOST original and this is a great opportunity for you to move on to a better vendor. I call BS to the service human text as it is nowhere near a copywrited term in my books. Your artwork is among the very best and for me to shell out a few bucks for two shirts means I put my money where it counts! Does this mean you can't use any words in your art? Seriously, it's humor, tell TS to FOAD and find a better way, we the people will always support you!

Scott Metzger

Thanks Donald. I’m glad you got a couple shirts while you could. I call BS on it too but there are other good print on demand sites. Onward and upward!

Karen Jagielo

Wow! Who knew? I'm kinda in agreement with the guy in the cartoon....so, it's really "a thing" !?!? 😂😂 oh well....good riddance to Teespring and here's to the next adventure! 😊

Julie Rentz

I'll be watching for your new store!!!!!

I wonder if the people who copyrighted the term actually use it or if they are trolls who make their money by copyrighting generic terms that shouldn't be allowed and hitting people up for money. And while I had been fine with teespring as a buyer before this, I prefer companies with common sense and reasonable business practices, so not planning on buying from them in the future.

Scott Metzger

Yeah, it's really disappointing that Teespring wasn't reasonable about this. I certainly won't buy any more products from them.

Nancy DeStadio

What a shame to punish you for an innocent post. As you said the art work was your own. I bought my Dave the Stray coffee mug from TeeSpring and was pleased with the service. To end a long working relationship on a sour note sucks. Wherever you go I will support your creative talents. I’ll still hope for something with Steve and the check for the puffy tail cartoon as I love that one.

Melissa Kidd

Their loss! We still want your loot and they are dead to us too!

Jill Gerstenberger

That would piss me off too! Just let you make the change and move forward!

Scott Metzger

Exactly! That would’ve been the reasonable way to go

Nancy DeStadio

I just got a 20% discount offer from TeeSpring. I unsubscribed. That will show em!

So here is a thought, why not recaption the term? "helper minion" or any of a lot words. Or is every word in the entire English language trademarked? I gather it is only because you are a legitimate cartoonist that it became an issue. I thought satire and humor were excluded from any perceived infringement issues?

Scott Metzger

Yeah, I gave it some more thought and I’m going to change the wording on the vest. People seem to really like this cartoon so I’ll include it in the book
