Tbh the reason Snake took that approach (which is a bit weird and out of character) is Kojima wrote himself into a corner. Emmerich is important to another character's backstory in the chronology, so technically past releases (he doesn't make an appearance just gets mentioned) so they kind of NEED him to live. I agree that he probably should have been jailed. It's not that I can't see Snake being merciful, it's that he is a straight up liability. There is maybe one justification I can think of but it's a reach and contains spoilers.

Hearing Strangelove (the Boss' lover with the red coat from Peace Walker) suffocate in that pod is one of the most haunting pieces of audio in the game to me. Hearing her admit she didnt necessarily like Huey, and she thought if she could just raise a child to have the Boss' ideals and kindness, that she could consider it the Boss' child instead of Huey. That the father would be irrelevant. She just wanted to see the woman she loved again. Forced to build an AI? Might as well base it on the Boss' brain and memories. Weird stalker coworker wants a relationship? Well at least you can raise a child like the Boss would. Except the AI committed suicide and coworker is a sociopath that killed her. Happy fun times indeed

I know the next metal gear game is approaching fast..if you are reading this,please make sure you READ or watch a compilation of the story of metal gear 1 and 2( not metal gear solid) as those two very old games are the next in line according to the chronology of the franchise...they are the start of solid snake saga as big boss saga ends with this game(phantom pain)...then you are safe to move to Metal gear SOLID 1..and remember,MGS is one of those franchises where you cant understand the story much at all if you Skip any ONE game...thats all,Cheers!
