Look at what gets done to Tommy Robinson. It’s rules for 1 and rules for the other

Charlie Nicolson

If you hear someone say something unpalatable, do you challenge them on it? For example, I've been challenging use of "Hun" for over a decade

Lynsey Roddy

Thank you for discussing this awful law. It’s not going to be back dated so you don’t need to clean up any social media comments made before then & you do have to have made the comments in Scotland but the person who is offended & reports the crime doesn’t need to be. It’s a shit storm about to hit us as there’s absolutely no doubt the likes of India Willoughby will use it to get anyone who disagrees with him investigated, he’s stated that already. The police have said they will investigates every complaint of a hate crime made & even if it’s decided the comments made weren’t criminal you will have a NON HATE CRIME INCIDENT on your record without you even knowing. The Edinburgh Fringe will be a blast with every comedian petrified of offending an audience member! As someone who strongly believes in safe places for women & safe sports for woman & that the SNP are evil I will not suddenly believe that you can change gender & I will not kowtow to those who do. The hate crime law protects trans gendered people but not women so a man in a dress has more rights than a woman in one. JKR is going to be reported by every TRA out there & she’s already said she won’t back down so she might be the one who saves us from it! 🤷‍♀️

Rona Bluebell

For me, it isn’t about free speech it’s about educating people to have critical thinking skills to unpick why certain platforms exist and what their agenda is. GB News is deliberately funded to promote a right wing view to shift the political landscape, using hate as a populist tool. But those seduced by that don’t have the critical skills to understand how they’re being manipulated. Same with conspiracy theories. People unable to unpick the motives behind this.

Gregg

Stick to banging the Lawrence Shankland drum mate - this is not a hill to die on

Andy McGowan

Free speech absolutist here, let's not talk about Tommy Robinson 😂 I'd quite like H&H to be here next week

Gregg

We live in a society that is very polarised - where people tend to hear views that mirror their own. Via social media algorithms, the plethora of media choice, I think we have lost the ability to disagree in a respectful way now. Look at H&H - I don’t hear the balanced and sensible views of fans of other clubs and expert analysis from our non biased media. It might be turning me Uber staunch.

John McMillan

That was class guys. Really good episode. Ngl, I wasn't expecting a thoughtful debate on free speech when I put this on this morning. Class though. Free speech 7 Johnny.

David Taylor

Good discussion this morning. I’m genuinely scared by this proposed new legislation. I don’t hate anyone and would go out of my way not to offend anyone, but I like comedy, and dark humour, could you effectively have your life ruined by telling a joke in private company that someone overhears and reports you? I also find certain aspects of some religions ridiculous, if you comment or criticise any of these things, does that equate to a hate crime? From the outside, it looks like a very very bad law, that won’t last long but could adversely affect people in the short term. I don’t think it comes from a good place, I think it’s designed to be weaponised to shut down debate.

Jack Shaw

😂 my idea mate. We’ll back to Colin plumbing the depths of the internet next week

George Cook

Cracking pod guys, thanks

stevan castrissios

Great discussion lads. With this and the on line harms bills being prepped and trotted out in western countries kind of all at once. For me it’s only too predictable. Re the two points you raise i’d have scored them eights. Two fat ladies, 88.

Gary Staff

I’ve two podcast series for you gents on BBC sounds. Ones called “Things fell apart” with Jon Ronson and “The Coming Storm” That’s a series about the whole QAnon movement.

Roger Smith

Great show guys, really enjoyed the debate, better than the Nuptorium ones (might need to redact that). FSB rules ok.

Gary Staff

Have you listened to those series? They are about the culture wars and how we got where we are now.

Jack Shaw

The Ronson pods, yeah. The other one, no. I’ll take a look 👍🏼 The Debutante by Ronson is a good listen, as is The Last Days of August.

David Craig

Excellent bit of something different lads! Well in! 👌🏻 Been an issue I’ve been very interested in since Jordan Peterson rise to fame in tackling Canada’s bill C16 compelled speech laws. Great to hear you guys tackle the issue and what your thoughts were. Is Andy Scotland’s answer to Jordan Peterson? 🤔🤣

Stewart Thomson

Really great pod lads, I would recommend everyone read or listen to The Gulag Archipelago to see where we could end up if free speech is taken away from us.

Steven

Great show guys. Just shows if you are talented you can cover a range of subjects.

Paul Kerr

Excellent chat lads. Shows the minefield Scotland is entering. I guarantee everyone has said the phrase "I don't know why, but I just don't like him/her/them" which could be reported anonymously as a perceived hate crime. Not to mention the exploitation of the legislation by attention seekers, vindictive ex partners or paranoid delusionists for example. It's madness in my eyes to shut down debate and open that door in it's place.

Craig Watson

Here is my take, free speech is an earned right. I don't believe that free speech is being stopped, there are now more consequences for what you say. Vulnerable people should be protected and those who abuse them should face consequences.

Martin Davies

A noisy minority of people are so thin skinned that they find offense in virtually everything, and the majority have to tip toe around them. And people in the public eye are bending over backwards to accommodate the lunatic fringe for the fear of being cancelled. It's genuinely terrifying that we are marching towards an era where you will be labelled a hate monster, lose your job, etc with no way to defend yourself because the person who reported the "crime" doesn't have to justify it.

Jack Shaw

Colin will gobble that compliment right up 😂 Cheers Steven 👍🏼

Craig Watson

Of course it won't,but that doesn't mean we shouldn't try. The guide for anything is what a reasonable person would expect. That's word reasonable has been used in legislation for decades. Times change. Either get on with it or be Alf Garnett. 😂

Gary Brown

That is the next step where you will be punished for NOT reporting it. eg You're near a white guy who racially slurs a black friend. Black guy racially slurs his white friend back. They're not offended, neither complain. Another person nearby is shocked, offended and reports it them being a victim of hate crime. You are shocked but not offended and don't report it. You can be cited as a witness! A crime not to report the crime! I've not read the law on this. But I know for a fact that the principal I outlined, not reporting, and not challenging incidents such as that is well embeded into 'appropriate behaviour' standards in many employers rules, thinking and judgement.

Andy McGowan

What does "vulnerable" mean, and can I declare myself that or does someone else decide?

Craig Watson

By all means you can decide, but that would normally mean that you are not as you are demonstrating some capacity. In law it is basically people who have difficulty living a normal live due to illness, disability education either physically or mentally.

Rose Mcloughlin

What a minefield you are discussing....and the police are not happy about this new law as its so difficult to enforce....I dont want to live in a country where no one is allowed their say...other countries admire our freedom of speach...I think if someone is going to stand and scream abuse at me because we have different views would still be arrested without this new law....my greatest fear is my protestant stand for my religion will come under attack....it already is in a small way right now....we were not allowed to demonstrate but a hugh turn up of snp followers marched to edinburgh but police allowed this and told people to move on when the question was asked why was this allowed...and Nicola came out and cheered the march....this is scary.....I dont intend to abuse anyone and believe in live and let live..but I fear this law.

Colin Carstairs

My tuppence worth… it’s been designed to chill any free speak within this country. To me it’s to put members of on notice that any perceived hate will be investigated which will turn anyones life into a state of chaos even if it the courts don’t go forward with the perceived hate offence.. It’s designed to make you think twice about voicing your opinions whether people like them or not. I am stunned with the labour & Lib Dem’s who also voted this through… this doesn’t seem to have gotten much of any attention. People are being told to get into line or else imo. BTW fantastic pod always 👏👏

Blair McGunnigle

Great stuff lads. Enjoyed that today. More toleys next week though please!

Steven L

Interesting pod this week. 🤣🤣

Ross Guild

I applaud you boys for having the discussion 👏🏻

Gary Brown

Not a barrel of laughs but life isn't. Extremely interesting all the same. Thanks lads. Great to hear the viewpoints and debate. Really enjoyable listen. Thought provoking too.

Jim Milne

Trudeau is desperate to turn Canada into North Korea. Begs the question. As an expat, if I tweet something that's "illegal" in Scotland are the cops going to be ask to arrest me when I return on holiday? Bloody farcical.

Jim Milne

Sometimes a show like this is needed. Great debate with arguments from all views.

Jack Shaw

Posters all over my work about how to report a hate crime if you witness /FEEL that one has occurred.

Gordon Rennie

Agree with Andy, making great points.

Jay

Wow! Very thought provoking. Great show lads, thank you

Scotty

If this had been my first RBR I’d be looking for the back catalogue 👏🏻 well done on having the conversation. Free speech is the backbone of podcasting & social media so voting less than a 7 is precarious I think. Great listen lads 🫶🏻

Tom

I'm a free speech absolutist as well I'd say, Jordan Peterson's videos and podcasts might be interesting for anybody else wanting to hear debates about free speech etc.

Martyn Dick

The SNP (Humza) are bringing legislation in to favour minorities to garner votes - not through a sense of duty or morality …imo

Martin Boyd

Great pod , really enjoyed it. As for free speech I’m a 7 I cannot believe the wording Andy read out , astonishing.

Douglas Innes

You can't just listen to Martyn doing the Terence/Papa Swartz voice..... you have to listen to the story of Papa Swartz before you see it for what it is

Iain main

You should re release the papa Schwartz episode before you can’t after the 1st of April. 🫣

Owen Scott

Need to start listing the TV recommendations in the blurb of the show. I forget them as usually listen when driving.

Andy Forgrieve

Good show guys. As a way to protect yourselves on the Pod can you get around this nonsense by saying the content is recorded/played from servers outside Scotland :)

David

Colin the free speech police FFS.
